ACNC - Five Year Review

CCA encourages all in the charities and not-for-profit sector and the communites we serve to take an interest in the five year Review of the ACNC legislation.  CCA is preparing a submission in consultation with members.  

The Government is required to undertake a review of the Australian Charities and Not for profits Commission Act 2012 and the Australian Charities and Not-for-profits Commission (Consequential and Transitional) Act 2012 after their first five years of operation.  This review presents an opportunity to evaluate the performance of the legislative framework, the regulation of the sector and to identify any improvements that can be made.

The ACNC was established – and retained – with the support of the sector.  It is important the achievement of the first five years of the ACNC are built upon.  The Objects of the ACNC were developed in consultation with the sector, and were strongly supported. They are currently legislated as follows;

  • maintain, protect and enhance public trust and confidence in the sector through increased accountability and transparency
  • support and sustain a robust, vibrant, independent and innovative not-for-profit sector
  • promote the reduction of unnecessary regulatory obligations on the sector.

Assistant Minister to the Treasurer, Michael Sukkar MP released the Terms of Reference for Review on 20 December 2017.  Mr Patrick McClure AO has been appointed to chair the review panel, and will be joined by Ms Su McCluskey, Dr Matthew Turnour and Mr Greg Hammond OAM.

Submissions are due by 28 February 2018, with a final report to be presented to Government by 31 May 2018.
